When rent remains unpaid, a landlord may need both termination of the lease and lawful recovery of the property. Those objectives require a judicial strategy. Changing locks, removing possessions or forcing an occupant out without an enforceable order can create serious civil and criminal exposure, even when the landlord considers the debt undisputed.
Mexican lease disputes are especially sensitive to location. Substantive rules come from the civil code applicable where the property is located, while procedural rules depend on the jurisdiction and on the staged implementation of the National Code of Civil and Family Procedure. A rule described for one state should not be assumed to apply identically in another.
Begin with the lease and the payment record
The written lease is the first source for understanding payment dates, the agreed rent, permitted notices, guarantees, causes for termination and the parties' addresses. If the agreement was modified, the complete sequence of amendments and renewals matters as much as the original document.
A useful file normally includes:
- the signed lease and its annexes;
- proof that the landlord is entitled to lease or recover the property;
- a chronological rent ledger;
- bank statements, receipts and invoices relevant to payment;
- written payment demands and communications with the tenant;
- information about guarantors or other security; and
- the full address and current condition of the property.
The number of unpaid installments required to support a particular claim cannot be stated as a universal national rule. It depends on the governing civil law, the contract, the relief requested and the procedural route available in the place where the property is located.
The claim may involve more than possession
Depending on the facts, the landlord may seek termination or rescission of the lease, delivery of the property, overdue rent and other amounts that are legally recoverable. Each remedy has its own elements and evidence. A demand should distinguish rent from utilities, penalties, damage or other contractual charges rather than present one unexplained balance.
The tenant must be formally served and has a right to respond, raise defenses and offer evidence. A landlord should therefore assume that the payment history, authority of the person signing the lease and calculation of the amount claimed will be examined.
A national oral procedure is being implemented in stages
The National Code of Civil and Family Procedure includes a special oral proceeding for real estate leases. It contemplates concentrated pleadings and hearings and requires the written lease to accompany the complaint when the lease was made in writing. It also contains measures concerning overdue rent in qualifying cases.
Implementation is not a reason to assume that the national procedure already governs every new case in the same way. Its entry into force has been staged by jurisdiction, with a nationwide transition deadline. Before filing, counsel must confirm which procedural code is in force on that date and in that court.
This is particularly important in the State of Mexico. Venue, local court organization and the effective procedural regime should be checked for the municipality where the property is located. Notice should not be reduced to an internet formula
Online summaries often repeat a fixed notice period as if it applied to every eviction. Notice for expiration of a fixed term, early termination, nonpayment and a local housing rule may serve different purposes. Whether notice is required, and in what form, must be determined from the governing code and the lease.
Even when an out-of-court demand is not the event that creates the cause of action, a clear and properly delivered communication may help establish the chronology, narrow the dispute or support a negotiated return of the property. It should not contain threats or imply a right to use self-help.
Preparation reduces avoidable delay
Before litigation, the landlord should verify the identity of all parties, the exact property description, the accounting and the requested remedy. Settlement may be appropriate when it produces a documented surrender date, payment terms and consequences of default. If no agreement is viable, a complete evidentiary file allows the judicial process to begin on a clearer footing.
